The consumers have other legal resources available through which they may be able to obtain additional compensation, such as punitive damages. Punitive damages have the purpose of deterring future wrongdoing and can be claimed in cases that involve fraudulent conduct, such as Volkswagen's.
Our office is currently pursuing individual cases for our clients that decided to opt-out of the Class Action and pursue their claims for damages in State Court. For these cases a claim for punitive damages has been included. North Carolina law provides for punitive damages, up to $250,000. The cases are being pursued in Virginia, home state of Volkswagen, to prevent Volkswagen from removing the cases to federal court.
