William Hooper was driving a garbage truck on Surrett Drive in Trinity, North Carolina when the vehicle overturned. He claims that the garbage truck’s heavy load shifted and caused the vehicle to run off the road and overturn in a ditch. Hooper was charged with exceeding a safe speed because of the rainy conditions on September 27, 2010, the date of the automobile accident.
