Upcoming deadline for ASR patients without revision

Patients who received the recalled DePuy ASR hip implant system should take note of an upcoming deadline that may affect their legal rights.

The DePuy ASR hip implant cases have been consolidated in front of a Federal Judge in Ohio. Recently, the Court announced that a deadline has been extended for patients who have not had the defective device removed. The deadline applies to those individuals who have filed suit in Federal Court and have not yet had revision surgery to remove the DePuy ASR hip implant.

By January 31, 2015, you and your lawyer must decide whether to take a dismissal of the case, or to continue the suit. Contrary to what you may think, it could be in your best interest to take a dismissal and preserve a future claim if your injuries worsen.
